Acquiring property, be it a producing oil/natural gas field, commercial real estate or undeveloped land can be a cost-effective alternative to developing from the ground-up. Conversely, such properties are often sold when operating costs become too high or if the owner is looking to go in a different direction. Under current state and federal environmental regulations, a property owner may be held responsible for previous hazardous materials management or disposal practices on the property. The owner may be liable even if these practices were considered to be the industry standard at the time.
Kleinfelder/Buys & Associates has performed hundreds of environmental site assessments and property transfer audits to assess potential environmental liabilities associated with past and current operating practices. Audits include field inspections, review of permits and well files, and appraisals of waste handling and disposal practices. Information derived from these audits can be used in the negotiations for the transfer. An increasingly common practice is to make an acquisition contingent upon the conclusion of a successful environmental audit.
Our staff meet the minimum qualifications for Environmental Professionals (EPs) as defined in CERCLA AAI, and are experienced and competent in completing ESAs following the American Society of Testing Materials (ASTM) Standard Practice for Environmental Site Assessments (E1527-05). Additionally, B&A's professionals have extensive experience conducting Phase I/II ESAs under stringent time constraints, often in remote locations.

An independent oil and gas company that has operations in Texas, Louisiana and the Rocky Mountains retained Buys & Associates to conduct compliance audits of their Texas operations. The audits consisted of a field office records review and inspection of selected properties from various field office locations. The audits were conducted at the central Texas and west Texas district offices to determine the degree of compliance with applicable state and federal regulations. In conjunction with the field activities, a review of operations was also performed at the corporate office.
The audits of the district offices included scrutiny of files pertaining to Spill Prevention, Control and Countermeasure (SPCC) plans, air permits, spill history and reporting, Underground Injection Control (UIC) activities, and waste handling procedures. Inspection of company operated properties for each district was also conducted to assess on-site compliance with environmental and safety regulations.
The information discovered during the audit was used to evaluate the oil company's overall corporate environmental compliance, identify and correct noted deficiencies and organize the company's resources to maintain environmental records more effectively.

Buys & Associates, Inc. conducted a Phase I Environmental Site Assessment (ESA) for a oil & gas operator for 315 sites comprising approximately 1,000 acres located in areas of limited access in the states of Arkansas, Louisiana, Mississippi, New Mexico, Oklahoma, and Texas. The ESA was completed prior to purchase of these properties and was conducted in compliance with E1527-05 and AAI. Activities included site reconnaissance, interviews with current and past owners and operators, environmental records review, and historic records review. The ESA was completed in under a month.
